My Expert Coach provides executive-level career strategy, personal branding, executive leadership coaching, résumé and LinkedIn profile development, interview preparation, and compensation negotiation coaching (collectively, the “Services”).

Detailed scope, timelines, and deliverables for specific paid engagements will be outlined in separate client agreements or proposal documents provided prior to service commencement.

2. Professional Disclaimer & No Guarantee of Outcomes

Consulting & Coaching Nature: Our Services are strategic, educational, and advisory in nature. While Sandy Spencer, MBA brings over 25 years of professional recruiting and career strategy experience, individual results depend heavily on market conditions, individual effort, industry demand, and third-party hiring decisions beyond our control.

• No Employment Guarantees: We do not guarantee job placement, interview offers, specific salary increases, or employment outcomes.
• Not Legal or Financial Advice: Advice provided regarding compensation, employment contracts, or job negotiations does not constitute formal legal, accounting, or financial advice. Clients should consult qualified legal or financial professionals for legal agreements.

3. Confidentiality & Client Information

We hold all client communications, résumés, career histories, and strategy sessions in strict confidence, in accordance with our Privacy Policy.

You represent that all information, work history, credentials, and achievements provided to us are accurate, truthful, and complete. You agree not to request the creation or inclusion of misleading or fraudulent information in any career or marketing materials.

4. Intellectual Property Rights

• Site Content: All content, graphics, logos, branding, copy, text, and design elements on this Site are the intellectual property of Expert Business & Professional Services, Inc. and are protected by applicable copyright, trademark, and intellectual property laws.
• Client Deliverables: Upon full payment for Services, clients receive a personal, non-exclusive license to use, reproduce, and distribute the customized résumés, cover letters, and LinkedIn profile text produced specifically for them for their personal career advancement.
• Proprietary Frameworks: Any underlying templates, strategic frameworks, intake questionnaires, or coaching methodologies used by My Expert Coach remain the exclusive property of the Company.

5. Fees, Payment, and Refunds

• Payment Terms: Fees for consultations, coaching programs, or résumé packages are due in advance of service delivery or according to the payment schedule agreed upon in your specific client agreement.
• Refund Policy: Due to the custom, time-intensive, and advisory nature of executive coaching and personal branding services, all fees paid are non-refundable once work on an engagement or strategy intake has commenced, except as explicitly provided in a written agreement signed by the Company.

6. Consultations and Scheduling

• Consultations: Initial strategy consultations must be scheduled in advance through our designated scheduling channels.
• Cancellations & Rescheduling: If you need to cancel or reschedule a booked coaching or consultation session, you must provide at least 24 hours’ advance notice. Failure to provide timely notice may result in forfeiture of that session.

7. User Conduct & Acceptable Use

You agree not to use the Site or its contact mechanisms to:

• Transmit spam, unsolicited commercial communications, or malicious code (e.g., viruses, malware).
• Attempt to gain unauthorized access to our servers, web host (Plesk), or connected databases.
• Impersonate any person or entity or misrepresent your affiliation with a person or firm.
• Use automated scrapers or bots to collect content from the Site without explicit permission.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Expert Business & Professional Services, Inc., Sandy Spencer, and its affiliates, officers, or agents shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Site, reliance on site content, or use of our Services.

Our total aggregate liability for any claims arising from these Terms or our Services shall not exceed the total amount paid by you to the Company for the specific service giving rise to the claim during the six (6) months prior to the event.

Any legal action or proceeding arising out of or relating to these Terms or the Site shall be instituted exclusively in the state or federal courts located in Miami-Dade County, Florida.
